This document sets out the terms on which Monolit Ecom Distribution FZCO (Dubai Airport Freezone (DAFZA), Dubai, UAE) accepts, carries, clears and delivers shipments. It follows the clause structure the international express industry uses for terms of carriage. The terms are accepted when a shipment is handed to the Company or when the service is paid for.
By handing a shipment to the Company you act as the Shipper — on your own behalf, on behalf of the Recipient, and on behalf of anyone else with an interest in the shipment — and you confirm that these terms apply to all of them.
"Shipment" means the contents and packaging accepted under a single intake document, however and by whatever means it is carried and through whatever intermediate points. "Intake document" means the document or electronic record by which the Company confirms acceptance and assigns a tracking number.
Every shipment is carried on the limited liability basis set out in clause 6. If you need greater protection, declare the value of the contents and arrange shipment insurance — clause 8.
To provide the service, the Company may, on behalf of the Shipper or the Recipient: prepare and submit the documents required for export and import; correct commodity codes; act as, or appoint, a customs broker — an official customs partner of the Company; advance duties, taxes and charges; and redirect a shipment to the Recipient’s own customs broker on the reasonable request of an authorised person.
The Shipper and Recipient must provide any further authority or document that applicable law requires for clearance.
A shipment is not accepted for carriage if:
The full list with an explanation for each category is in the Prohibited and Restricted Items document, which forms part of these terms. Some items may be accepted for a corporate customer under a separate agreement where all required permits are in place.
A shipment is delivered to the address given by the Shipper, or to a pickup point. Delivery to an address does not mean delivery to the named Recipient in person: at premises with a central mail room, the shipment is delivered to that mail room.
The Company may notify the Recipient of an upcoming delivery and offer alternatives: delivery on another day, collection at a pickup point, or redirection.
If a shipment is unacceptable under clause 2, has been undervalued for customs purposes, the Recipient cannot be identified or found, or the Recipient refuses the shipment or refuses to pay duties and charges, the Company will take reasonable steps to return the shipment to the Shipper at the Shipper’s cost. If return is not possible, the shipment may be placed in storage, sold or disposed of without liability to the Shipper or anyone else.
The Company may destroy any shipment whose return is prohibited by law or by a law enforcement authority, and any shipment containing dangerous goods.
The Company may open and inspect a shipment without prior notice — for safety or security reasons, for customs clearance, or where applicable law otherwise requires it.
Carriers and government authorities have the same right. The Company is not liable for delay caused by inspection by a government authority.
Carriage charges are calculated on the higher of actual or volumetric weight per piece. The Company may re-weigh and re-measure any piece to verify the calculation.
The website quote is indicative. The final price is set from the measurements taken at intake and confirmed before payment.
Duties, taxes and charges in the destination country are not included in the carriage price unless expressly stated. They may be requested from the Recipient before delivery. Where the Company has advanced such payments or used its own credit with the customs authority, those amounts and a service fee are reimbursable.
If the Recipient has not paid the amounts due, the obligation to pay or reimburse them falls on the Shipper.
The Company’s liability for any one shipment carried by air, including ancillary road carriage and stops en route, is limited in accordance with the applicable international air carriage convention — the Montreal Convention or the Warsaw Convention. In the absence of an applicable convention, liability is limited to the lower of the current market or declared value of the contents, or 22 Special Drawing Rights (SDR) per kilogram of the shipment.
Liability is strictly limited to direct loss of or damage to the shipment itself and to the per-kilogram limits above. All other categories of loss are excluded, including lost profit, lost income, interest, and loss of a contract or business opportunity — whether direct or indirect, and even if the Company was aware of the risk.
The Company takes reasonable steps to meet planned delivery timeframes, but those timeframes are not a commitment and do not form part of the contract. The Company is not liable for loss caused by delay.
The SDR rate floats and is published by the International Monetary Fund; a fixed dollar equivalent is deliberately not stated here. Whether the Montreal or the Warsaw Convention applies depends on the states of origin and destination and is subject to confirmation by legal counsel.
A claim must be submitted in writing to logistics@monolit.ae and must include the tracking number, a description of the contents, what is being claimed, and supporting documents: the intake document, evidence of the value of the contents, and — for damage — photographs of the packaging and contents.
A claim for damage or shortage must be raised on receipt and recorded in the delivery document; concealed damage must be raised immediately on discovery.
The applicable international air carriage convention sets deadlines for raising a claim — in particular, no later than fourteen days for damage to cargo and twenty-one days for delay, counted from the date the shipment was placed at the recipient’s disposal — together with an overall two-year limitation period for bringing an action. Missing these deadlines extinguishes the right to claim.
One claim is accepted per shipment; its settlement is full and final for all claims connected with that shipment.
Any shorter contractual claim window the Company chooses to set is subject to review by legal counsel and will be stated here. Until then the periods set by the applicable convention and by contracts with the carriers used apply.
If the limits in clause 6 are not sufficient for you, declare the value of the contents at intake and arrange shipment insurance. Insurance is arranged on the Shipper’s written instruction, before the shipment enters carriage, and is paid for separately.
Insurance covers loss of or damage to the contents themselves. It does not cover indirect loss or loss caused by delay.
Which categories of contents are insurable, the cover limits, the premium rate and the insurer are subject to confirmation and will be stated here. Until then insurance is arranged individually on request.
The Company is not liable for loss, damage or delay arising out of circumstances beyond its control. These include, in particular:
The Shipper indemnifies the Company, its directors, employees and agents against all losses, liabilities and costs arising out of the Shipper’s failure to comply with the representations and warranties below. By handing over a shipment, the Shipper represents and warrants that:
The Shipper agrees to any routing and any change of routing, including carriage via intermediate stopping places and consolidation of the shipment with those of other customers into a single load. Consolidation is a standard way of reducing carriage cost and transit time.
Personal data provided to the Company in connection with a shipment is processed for carriage, customs clearance, delivery and compliance with legal obligations. Processing is described in the Privacy Policy.
Carriage by definition involves transferring Recipient data to the destination country, and to the customs broker, carriers and government authorities to the extent needed for clearance and delivery.
These terms are governed by the law of the UAE. Disputes not resolved through negotiation are to be heard by the courts of Dubai, and the Shipper accepts that jurisdiction save where mandatory rules of applicable law provide otherwise.
International carriage by air is additionally subject to the relevant international convention and to the terms of contracts with the carriers used.
The invalidity or unenforceability of any provision of these terms does not affect the validity of the remaining provisions.
The Company may amend these terms. The version in force on the date a shipment was accepted applies to that shipment: the version number is recorded in the intake document and in the record of acceptance.
